Congressman Johnson’s Statement on Supreme Court’s Ruling on Dismantling of Department of Education

WASHINGTON, D.C.– Today, Congressman Hank Johnson (GA-04), ranking member of the Judiciary Subcommittee on Courts, Intellectual Property, Artificial Intelligence, and the Internet, released the following statement after the Supreme Court ruled 6-3 along partisan lines this week allowing President Donald Trump to dismantle the Education Department — and to go through with laying off nearly 1,400 employees.

“The Supreme Court’s recent ruling allows Donald Trump to dismantle the Department of Education now, while challenges to the legality of his action remain to be decided at a later date. The damage will have already been done when the cases arrive back before the Court for final decision. This breathtaking shift of power to the Presidency does grievous harm to the system of checks and balances that has enabled 249 years of American democracy to thrive. Under our Constitution, Congress has the sole authority to dismantle any U.S. department — not Donald Trump or billionaire drug-addled Elon Musk’s ‘DOGE.’ It’s as if the Supreme Court of the United States is hellbent on a mission to restructure American governance regardless of the clear and unambiguous wording of the Constitution.”
